Terms & Conditions

1. TERMS & CONDITIONS OVERVIEW

This website and the services made available through it are operated by Online Weddings by Madison (“we,” “us,” “our,” or “Company”). Throughout this website, these terms refer to Online Weddings By Madison.

By accessing our website, scheduling or purchasing our services, communicating with us, or otherwise using any portion of our website or services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all visitors, customers, clients, and other users of our website and Services.

Please read these Terms carefully before using our website or purchasing our Services. If you do not agree with these Terms, you should not access the website or use our Services.

We may update these Terms from time to time. Any revised Terms will become effective when posted on this website unless otherwise required by applicable law. Your continued use of the website or Services after revised Terms are posted constitutes your acceptance of the updated Terms.

Our website may be hosted or supported by third-party technology providers, including Wix and other service providers. Your use of third-party platforms may also be subject to their respective terms and policies.

2. ELIGIBILITY

You must be at least 18 years old to purchase or use our Services unless otherwise permitted by applicable law.

By using our Services, you represent and warrant that:

- You are legally capable of entering into a binding agreement;
- The information you provide to us is truthful, complete, and accurate;
- You will comply with these Terms and all applicable laws and regulations; and
- You will not use our Services for an unlawful or unauthorized purpose.

3. OUR SERVICES

We provide online wedding and officiant services, including services associated with online marriage ceremonies and related customer support.

Our Services may include, depending on the package or service selected:

- Online marriage ceremony officiation;
- Identity or participant verification;
- Ceremony scheduling and coordination;
- Communication regarding ceremony logistics;
- Ceremony recordings or keepsakes, when offered;
- Assistance communicating with applicable government offices when expressly offered; and
- Other services specifically described at the time of purchase.

The specific Services included in your purchase are determined by the service description, package, confirmation, or other written agreement applicable to your order.

We reserve the right to modify, discontinue, or restrict any Service at any time, subject to applicable law and any obligations we have already agreed to provide.

4. WE ARE NOT A LAW FIRM OR GOVERNMENT AGENCY

Online Weddings by Madison is not a law firm, attorney's office, or government agency. We do not provide legal advice.

Our Services are limited to the services expressly described on our website or in your purchase agreement.

We do not make decisions regarding whether you are legally eligible to marry, whether a marriage license should be issued, or whether a marriage certificate or other government document will be accepted by a particular governmental authority.

You are responsible for determining whether our Services are appropriate for your circumstances and for obtaining independent legal advice when necessary.

5. MARRIAGE LICENSE APPLICATION AND GOVERNMENT PROCESSES

The marriage license application, review, approval, issuance, and maintenance of government marriage records are handled by the applicable governmental authority and are separate from our officiant Services.

For marriages utilizing the Utah County online marriage process, the marriage license application is completed through the Utah County Clerk's Office and its official online marriage application system: Utah County Marriage License Application.

We do not control the government's eligibility requirements, application procedures, processing times, approval decisions, issuance of marriage licenses, issuance or delivery of marriage certificates, apostilles, or other government documents.

You are solely responsible for ensuring that all information submitted to the government is complete, truthful, and accurate.

Although we may, when offered, provide reasonable courtesy assistance communicating with a government office regarding an administrative issue, such assistance does not make us responsible for the government's decision, records, processing time, or final outcome.

6. CUSTOMER RESPONSIBILITIES

You agree to provide accurate and complete information when scheduling or purchasing our Services.

You are responsible for:

- Providing accurate names, dates of birth, identification information, contact information, and other requested information;
- Ensuring that all information submitted to a governmental authority is accurate;
- Providing valid identification when required;
- Appearing for your scheduled ceremony at the required time;
- Following reasonable instructions provided by our officiant or staff;
- Maintaining access to the email address and telephone number associated with your booking;
- Ensuring that your internet connection, device, camera, microphone, and other required technology are functional when applicable; and
- Informing us promptly of any circumstances that could prevent the scheduled Service from occurring.

We are not responsible for delays, cancellations, or failures caused by inaccurate information, unavailable participants, defective customer equipment, internet connectivity problems, or circumstances outside our reasonable control.

7. SCHEDULING AND CEREMONIES

Ceremonies must be scheduled according to the availability presented by us.

You are responsible for arriving or connecting on time and ensuring that all required participants are available.

If you are late, fail to appear, are unable to participate, or otherwise prevent the ceremony from proceeding, we may require the ceremony to be rescheduled and may apply any applicable rescheduling or cancellation fees disclosed at the time of purchase.

We reserve the right to end or refuse a ceremony if we reasonably determine that the participants are engaging in threatening, abusive, fraudulent, unlawful, disruptive, or inappropriate conduct.

8. FEES AND PAYMENT

All prices displayed on our website are subject to change unless otherwise agreed in writing.

Payment must be received according to the payment terms presented at checkout or during scheduling.

You authorize us or our payment processor to charge the payment method you provide for the Services you purchase and any other amounts that you expressly authorize.

We reserve the right to correct pricing or description errors and, where permitted by law, cancel or refuse an order affected by an obvious error.

9. REFUNDS, CANCELLATIONS, AND RESCHEDULING

Refunds, cancellations, and rescheduling are governed by our applicable Refund and Cancellation Policy.

Where applicable, the Refund Policy is incorporated into these Terms by reference.

Nothing in these Terms is intended to waive any refund or cancellation rights that cannot legally be waived under applicable law.

10. ACCURACY OF INFORMATION

We make reasonable efforts to ensure that information published on our website is accurate and current. However, we do not warrant that all information will always be complete, accurate, reliable, or error-free.

Website content may include general information about our Services and governmental processes. Such information is provided for general informational purposes and should not be interpreted as legal advice or as a guarantee of a particular governmental outcome.

We reserve the right to correct errors, omissions, inaccuracies, or outdated information at any time.

11. THIRD-PARTY SERVICES AND LINKS

Our website or Services may contain links to third-party websites, applications, payment processors, video platforms, government websites, or other services.

Third-party services are controlled by their respective providers. We do not control and are not responsible for third-party websites, services, policies, availability, security, content, or practices.

Your use of a third-party service may be subject to additional terms imposed by that third party.

12. CEREMONY RECORDINGS

When offered, ceremony recordings may be provided as a courtesy or keepsake.

Unless expressly stated otherwise in writing, ceremony recordings are not guaranteed to be permanently stored or archived by us.

We are not obligated to retain, reproduce, restore, or replace a recording after it has been delivered or after the applicable retention period has ended.

Technical problems, corrupted files, platform failures, equipment problems, or other circumstances may occasionally prevent a recording from being created or delivered.

Where a recording is provided, you acknowledge that it is a keepsake and not an official government record.

13. USER CONTENT AND COMMUNICATIONS

If you provide photographs, written material, comments, reviews, testimonials, suggestions, or other content to us (“User Content”), you represent that you have the right to provide that content and that doing so does not violate another person's rights.

You retain ownership of your User Content.

By voluntarily submitting content to us for purposes related to providing the Services, you grant us a limited, non-exclusive license to use that content as reasonably necessary to provide, administer, or improve the Services.

We will handle personal information in accordance with our Privacy Policy.

14. PRIVACY

Information collected through our website and Services is handled according to our Privacy Policy.

By using our website and Services, you acknowledge that you have had an opportunity to review our Privacy Policy.

15. PROHIBITED CONDUCT

You may not use our website or Services:

- For an unlawful purpose;
- To commit fraud or misrepresentation;
- To impersonate another person;
- To provide false or misleading information;
- To interfere with the operation or security of our website or Services;
- To transmit malicious software, viruses, or harmful code;
- To attempt unauthorized access to our systems or accounts;
- To infringe upon another person's intellectual property or other legal rights;
- To harass, threaten, abuse, intimidate, or defame our employees, contractors, officiants, or other individuals;
- To interfere with another customer's use of our Services; or
- For any purpose prohibited by these Terms or applicable law.

We may suspend or terminate Services when we reasonably believe that a user has violated these Terms or engaged in conduct that threatens the safety, security, or proper operation of our business.

16. INTELLECTUAL PROPERTY

Unless otherwise stated, the content of this website—including text, graphics, photographs, logos, branding, videos, designs, and other materials—is owned by or licensed to Online Weddings by Madison and is protected by applicable intellectual property laws.

You may view and use website content for your personal, non-commercial purposes in connection with evaluating or purchasing our Services.

You may not reproduce, distribute, modify, sell, publish, copy, or commercially exploit our website content without our prior written permission.

17. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, our website and Services are provided on an “as is” and “as available” basis.

We do not guarantee that:

- The website or Services will always be available;
- The website will be free from errors or interruptions;
- Communications or recordings will always be successfully transmitted or stored;
- Our Services will meet every individual expectation;
- A governmental authority will approve an application;
- A governmental authority will issue a marriage license or certificate;
- A government agency will process documents within a particular timeframe; or
- Any particular legal, governmental, immigration, tax, or other outcome will result from using our Services.

Nothing in these Terms excludes a warranty, right, or remedy that cannot legally be excluded.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Online Weddings by Madison, together with its owners, officers, employees, contractors, agents, affiliates, service providers, and representatives, will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of our website or Services.

This includes, to the extent permitted by law, losses arising from governmental decisions, delays, rejected applications, incorrect information submitted by a customer, failure to receive government documents, internet or technology failures, third-party services, or circumstances beyond our reasonable control.

To the maximum extent permitted by applicable law, our total liability arising from your use of the Services will not exceed the amount you actually paid to us for the specific Service giving rise to the claim.

Nothing in this section limits liability that cannot legally be limited or excluded.

19. GOVERNMENT DOCUMENT DELIVERY

Government-issued marriage certificates, apostilles, licenses, and other official documents are issued and delivered by the applicable governmental authority.

We do not control the government's mailing procedures, delivery methods, processing times, or delivery outcomes.

You are responsible for providing the government with accurate mailing and contact information and for following any applicable procedures concerning replacement or reissuance of government documents.

20. INDEMNIFICATION

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Online Weddings by Madison, its owners, officers, employees, contractors, agents, affiliates, and service providers from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising out of or related to:

- Your violation of these Terms;
- Your violation of applicable law;
- Information you provide that is false, inaccurate, or misleading;
- Your misuse of our website or Services;
- Your violation of another person's rights; or
- Your negligent or intentional misconduct.

21. FORCE MAJEURE

We will not be responsible for delays or failures in providing Services caused by circumstances beyond our reasonable control, including natural disasters, severe weather, government actions, internet or telecommunications failures, power outages, labor disruptions, illness, emergencies, cyber incidents, third-party platform failures, or other circumstances that could not reasonably have been prevented.

When reasonably possible, we will attempt to communicate material disruptions and provide appropriate rescheduling options.

22. TERMINATION

You may stop using our website or Services at any time, subject to any payment, cancellation, or refund obligations applicable to your purchase.

We may suspend or terminate your access to our website or Services if you violate these Terms, provide fraudulent or misleading information, engage in abusive or threatening conduct, interfere with our operations, or otherwise create a reasonable concern regarding the safety, security, or integrity of our Services.

Termination does not eliminate obligations that arose before termination, including payment obligations, indemnification obligations, intellectual property provisions, disclaimers, limitations of liability, and other provisions that by their nature should survive termination.

23. RESPECTFUL COMMUNICATION

We are committed to maintaining a professional and respectful environment for our customers, officiants, employees, and contractors.

Harassment, threats, intimidation, abusive communications, discriminatory conduct, or repeated inappropriate behavior will not be tolerated.

If a customer engages in such conduct, we reserve the right to suspend or terminate communications or Services to the extent permitted by law.

Nothing in this section prevents a customer from exercising any lawful right to submit a complaint, dispute, chargeback, legal claim, or regulatory report.

24. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

25. NO WAIVER

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.

26. ENTIRE AGREEMENT

These Terms, together with any policies or agreements expressly incorporated by reference, constitute the agreement between you and Online Weddings by Madison concerning your use of our website and Services.

They supersede prior or contemporaneous representations concerning the same subject matter, except for any separate written agreement expressly entered into by the parties.

27. GOVERNING LAW

These Terms will be governed by and interpreted according to the laws of the State of Utah, without regard to conflict-of-law principles, except to the extent that applicable law requires otherwise.

Any dispute will be handled in the courts or through another dispute-resolution process having appropriate jurisdiction, subject to any rights that cannot legally be waived.

28. CHANGES TO THESE TERMS

We may revise these Terms from time to time.

The updated version will be posted on this website with a revised “Last Updated” date. Your continued use of our website or Services after the revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
